ORDINANCE NO. 3694

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MISSION ABANDONING A PORTION OF SCHUERBACH ROAD AND LEONOR STREET WHERE SAID TWO STREETS INTERSECT BEING AN IRREGULAR SHAPED PORTION OF EXISTING RIGHT OF WAY LYING IMMEDIATELY SOUTH AND ADJACENT TO THE BORDER PACIFIC RAILROAD COMPANY RIGHT OF WAY, AND ALSO LYING NORTH AND WEST OF LOT 1, MRS. E.V. FLORES SUBDIVISION, MISSION, HIDALGO COUNTY, TEXAS.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MISSION, TEXAS THAT:

Section 1. The City Council does by these presents abandon a 0.09 acre portion of Schuerbach Road from its centerline eastward; and a portion of Leonor Street being a distance of 29.44’ eastward from its intersection to Schuerbach Road, where said irregularly shaped portion of subject Right of Way, and also lying north and west of Lot 1. Mrs. E.V. Flores Subdivision, more specifically shown in ATTACHMENT A subject to:

a. The entire subject property shall be retained as a utility easement; and,

b. The favorable action by the County of Hidalgo to similarly abandon and receive a utility easement to the west half of the irregularly shaped right-of-way.

Section 2. This ordinance shall be recorded at the County Clerks’ Office of Hidalgo County, Texas.

READ, CONSIDERED, APPROVED  AND PASSED  on this the 10th day of October, In the Year of Our Lord, 2011.
